Ending a relationship can be one of the most traumatic events you will ever experience. This is especially so when children are involved. Our award winning team are highly experienced in helping our clients with pragmatic legal advice but also as a shoulder to lean on when days are particularly tough.
Most of us have heard of a Divorce but not everyone knows that there are often 3 separate Legal steps in a Divorce.
Divorce is the dissolution of marriage through a legal process by filing an application in a court of law. You do not have to provide a reason for the breakdown of your marriage, just a statement that your marriage has broken down.
On average, the divorce process in England and Wales takes six-eight months.
A financial agreement is one which regulates how you divide your assets and deal with any income post-separation. It is important that an agreement is formalised by a court order (called a financial remedy consent order), to make it binding.
Courts will only wish to get involved with issues concerning children when all other options have been exhausted.
If negotiation either by solicitors or through mediation is not successful, the final alternative would be to make an application to the court.
In addition to the separating couple, others may be impacted by a divorce. From;
- family members such as parents or siblings,
- friends
- to limited companies and partnerships
who may have an interest in assets.
Those with an interest may need to be represented as intervenors. Wildcat Law regularly provide advice to potential intervenors or where intervenors are already involved.
Divorces can become incredibly complex for High Net Worth clients and especially those that have:
Defined Benefit Pensions
Trusts
Family Businesses
Properties
Assets abroad
LTIPS
That is why, unlike most law firms, our Divorce team is led by a Divorce specialist Barrister who was awarded "Lawyer of the year - Family Law" 2024. This means that you have access to award winning specialist advice from day 1 rather than later in proceedings.
Many of our client's have complicated finances including assets overseas. In addition we regularly work with clients who are divorcing narcissistic partners or where gas lighting has occurred.
At Wildcat we take pride in the fact our services are designed for our clients. That is why we have a Barrister led approach. Most Solicitor's firms will only turn to a Barrister for advice on complex matters later in proceedings, we believe that client's should have access to expert advice from the start.
We also have an inhouse financial specialist a former Coutts Director who has over 20 years experience in financial services working with some of the wealthiest and high profile families in the world.
If all stages of divorce can be arranged through mutual agreement it will not only save significant costs, but ultimately help in building future relationships. This is especially so where young children are involved.
Our team can assist where you have already reached an agreement over finances or where you simply require assistance to reach an agreement. From drafting to advice our team can help.
We want to know your needs exactly so that we can provide the perfect solution. Let us know what you want and we’ll do our best to help.
