Steps involved in Divorce

Most of us have heard of a Divorce but not everyone knows that there are often 3 separate Legal steps in a Divorce.

The Legal Divorce

Divorce is the dissolution of marriage through a legal process by filing an application in a court of law. You do not have to provide a reason for the breakdown of your marriage, just a statement that your marriage has broken down.

On average, the divorce process in England and Wales takes six-eight months.

Financial Arrangements

A financial agreement is one which regulates how you divide your assets and deal with any income post-separation.  It is important that an agreement is formalised by a court order (called a financial remedy consent order), to make it binding.

Arrangements for Children 

Courts will only wish to get involved with issues concerning children when all other options have been exhausted.

If negotiation either by solicitors or through mediation is not successful, the final alternative would be to make an application to the court. 

Intervenors - 3rd Party Interests

In addition to the separating couple, others may be impacted by a divorce. From;

- family members such as parents or siblings,

- friends

- to limited companies and partnerships

 who may have an interest in assets.
